Las Vegas Cop Arrested for Lewdness with a Minor

Yesterday a forty-three year old policeman turned himself in after he was accused of the Nevada crime of lewdness with a minor under 14. He had been with Las Vegas Metro for four years and has been suspended without pay pending the case. The Juvenile Sexual Abuse Detail investigated him.

The Nevada crime of lewdness with a minor under 14 is any "lewd or lascivious act upon the body, or any part or member thereof, under the age of 14" with the intent of gratifying the defendant or the child sexually. Therefore, a person can be convicted of this crime without having had sexual intercourse or any type of penetration with the victim. Common defenses to this crime are false allegations, mistaken identity, or insufficient evidence.

Lewdness with a minor is a category A felony, which is the most serious class of crimes in Nevada. A first offense carries a life sentence with the possibility of parole after ten years (and maybe a $10,000 fine in addition). A subsequent conviction carries life in prison with no parole.

Man Arrested for Lewdness with a Minor in Reno

Over the weekend Reno police arrested a fifty-year old man for the Nevada crime of lewdness with a minor. He allegedly sexually assaulted a ten-year old girl. He reportedly lives in an apartment with the girl's uncle.

The Nevada crime of lewdness with a minor is defined as committing any lewd or lascivious act upon the body of a child under 14 for the purpose of sexual gratification of either the child or the defendant. The touching doesn't have to be on a sex organ as long as the intent is sexual. Typical defenses include false accusations and insufficient evidence.

Former Nevada Pastor Arrested for Lewd Conduct with a Minor

Last month a sixty-nine year old man from Silver Springs was arrested for allegedly committing the Nevada crime of lewdness with a minor under the age of 14. The criminal complaint claims he encouraged a four-year-old to touch his genitals. The man is a former associate pastor.

The Nevada crime of lewdness with a minor under the age of 14 is defined as committing a lascivious act on the body of a child thirteen or younger with the purpose of sexual gratification of the defendant or the minor. The touching does not have to occur on a sexual organ. As long as the defendant had sexual intent, touching any part of a child would qualify as lewd conduct.

Standard defenses to this crime include false accusations and lack of evidence. Penalties include life in prison. For a first offense, the defendant may have the possibility of parole. Otherwise, there is no possibility for parole.

Former Bailiff Pleads to Lewdness with a Minor in Nevada

The former bailiff for former Clark County District Court Judge Elizabeth Halverson has pleaded guilty to violating lewdness with a minor law in Nevada. He was arrested back in February after allegedly assaulting a young teenage girl sexually. He will be sentenced on June 2 and is currently being held at the Clark County Detention Center on $170,000 bail.

According to the police report, the former bailiff sexually abused the girl while his mom and ex-fiancee talked with the victim’s mother outside of her house. The responding officer reported that the victim’s underwear appeared bloodstained. She reportedly told the police that he assaulted her.

Lewdness with a minor law in Nevada makes it a crime to commit any lewd or lascivious act upon a child under fourteen with the intent of receiving or giving sexual gratification. The touching does not have to be on a sex organ as long as it’s committed with sexual intent. The standard sentence for violating lewdness with a minor law in Nevada is life in prison.

Man Pleads Guilty to Nevada Crime of Lewdness with a Child Under 14

Last week, a twenty-one year old man in Winnemucca who was originally charged with sexual assault on a child pleaded guilty to the Nevada crime of lewdness with a child under 14. If he’s released, he’ll be placed on lifetime supervision. (The victim’s mother was sentenced for child abuse, neglect or endangerment for allowing the child to have sex with the defendant.)

The defendant’s attorney told the court, “My client has expressed to me remorse for this fact pattern. He just found himself unable to protect himself and protect the victim in this case and allowed some very base instincts to take over and for that he’s sorry.” The Humboldt County D.A responded in part, “I would ask this court to be mindful that this is a defendant who’s not remorseful and doesn’t take into consideration what his actions have caused to occur in this 11-year-old girl’s life.” The D.A. also quoted the defendant, who allegedly said the incident didn’t affect the girl negatively.

The Nevada crime of lewdness with a child under 14 outlaws any lewd or lascivious act on a child for the purpose of sexual gratification. Both sexual assault on a child and lewdness on a child carry life sentences, but a first conviction for lewdness allows for the possibility of parole after only ten years have been served. However, if the defendant has prior convictions for lewdness or similar crimes, the penalty is life without the possibility of parole.
