Two Drug-Related Child Endangerment Arrests in White Pine County

Nevada Drug Crime ChargesIn the final week of October, Ely reported two arrests for the Nevada crime of child endangerment. Both concerned men who allegedly possessed and sold marijuana in the presence of a child. One of them is being held on $30,000 bail.

The Nevada crime of child endangerment is knowingly placing the child in an environment that may harm the child's well being. Examples include transporting a child in a stolen car, or allowing a child to be in a drug den. Defenses to this crime include that the defendant had no reason to believe that harm may come to the child, or that the defendant was falsely accused.

The Nevada crime of child endangerment may be a felony or a gross misdemeanor depending on the egregiousness of the case. Willfully putting a child in harm's way that results in substantial bodily or mental harm is a category B felony carrying up to twenty years in prison. But merely permitting a child to be put in harm's way that results in no substantial harm is a gross misdemeanor carrying up to one year in jail as long as the defendant has no previous child abuse convictions.
